Subject to paragraph 2, BGC will ensure that its compliance function pre-certifies and records that the transmission of any client order in listed derivative instruments to an affiliate within the BGC Group is in the best interest of the client, including that the relevant affiliate does not charge commission to any relevant liquidity provider. This requirement will continue until such time as BGC has satisfied the FCA that it has implemented the necessary systems and controls to consistently achieve an equivalent outcome. 2. BGC is permitted to transmit orders to the electronic platform (“FENICS GO”) on which trades are arranged by BGC’s French affiliate, Aurel BGC (or other affiliates which BGC may notify the FCA of from time to time), provided that BGC has processes and procedures in place to ensure any relevant liquidity provider on the other side of a trade intermediated by a UK designated broker to FENICS GO are not charged a commission.
