What the FCA says

ATTENTION - Firm in an insolvency process

This firm is in an insolvency process. It is under the control of the appointed insolvency office holder(s) and may have stopped taking on new business. It has to continue to meet our standards in line with its regulatory status, including when dealing with its customers. If you are/were a customer check how this affects you with the firm or the appointed insolvency office holder(s).

Website, phone number and address

Compare these against whatever you were given. Scammers clone real firm names and reference numbers but use their own phone number and website, so a detail that does not match the register is the clearest warning sign there is.

Past FCA permissions and consumer protection

  • In an insolvency process
Money the firm held is returned through the appointed office holders, which takes time and can fall short. The FSCS covers eligible claims up to its limits, and the Ombudsman can still look at a complaint.

Limits on the record

  • Asset Retention
Holborn Assets Ltd (the Firm) applies under section 55L(5) of the Financial Services and Markets Act 2000 (FSMA) for its current permission under Part 4A of FSMA to be varied to include the following requirements, and for the requirements to be published on the FCA Register. Requirement 1 1.1. The Firm must not take any action which has, or may have, the effect of disposing of, dealing with or diminishing the value of any of its assets without the FCA’s prior written consent. 1.2. The Firm must not dispose of, transfer or sell in whole or in part its client base unless it has the FCA’s prior written consent. 1.3. This requirement does not prohibit the Firm from dealing with or disposing of any of its assets in the ordinary and proper course of business. For the avoidance of doubt, the following would not be in the ordinary and proper course of business for these purposes: (a) the making of any capital distribution; (b) the payment of unusual or significant amounts to the Firm’s shareholders, employees, officers or directors or any persons connected thereto; (c) the making of any gift or any significant loan by the Firm to any party; and (d) the entry into any financial reconstruction or organisation.
